Alabama Employers Likely Have Right to Enforce Vaccine Policy

In light of anticipation Pfizer and Moderna could release COVID-19 vaccines soon, some companies are talking with attorneys to make its application mandatory for employees, NBC 15 reported. Employees worried this could violate their constitutional rights are also reaching out to attorneys. “Some people say, if I don’t want to take the vaccine, then it’s my constitutional right not to take the vaccine. But you also must remember it’s the employer’s constitutional right not to keep you on,” Bill Eiland, attorney with Eiland & Ritchie in Mobile, said. However, he added that the law protects those with legitimate health reasons and religious beliefs, and he speculates proof of these conditions will be required to avoid vaccination. The attorney advised employers to start a dialog with their employees regarding the vaccine and “work something out” with those not wanting to take it.
