Tobias & Comer Wins $7 Million Verdict Against Altapointe Health

On March 1, the personal injury law firm of Tobias & Comer Law, LLC obtained a $7-million jury verdict for a young man who was sexually assaulted while a patient at AltaPointe Health System, Inc.’s BayPointe Children’s Psychiatric Hospital in Mobile. The jury found that AltaPointe did not meet the standard of care to protect a patient’s rights to be treated in a safe and humane place. Further, the jury found that AltaPointe did not protect the patient’s rights when it did not report the crime for almost 24 hours after the incident. The trial team was led by Bryan Comer and Lacey Smith. The jury deliberated for 2.5 hours before the verdict was read in Mobile County Circuit Court. The jury unanimously decided for the plaintiff and awarded $3 million in compensatory damages and $4 million in punitive damages.
